2. Agreement

Your use of the PLATFORM is conditioned on your compliance with the Terms and Conditions set forth below. Do not use the PLATFORM if you do not agree to these Terms of Use. The information and content provided on the PLATFORM and your access to the website do not create a legal relationship between you and IAMG.

IAMG may modify these Terms and Conditions at any time and such modifications will be effective immediately upon posting of the modified version on the Website. Your continued use of the website will constitute your conclusive acceptance of the modified Terms and Conditions. Contracts concluded on the basis of earlier versions of the general terms and conditions remain unaffected. However, it is your responsibility to provide evidence of the applicable terms and conditions.

Orders placed by you will be accepted subject to these Terms and Conditions and all contracts will be concluded in accordance with these Terms and Conditions. They prevail over any other terms and are effective notwithstanding any changes or additions contained in any order placed by you or any other document submitted by you. No modification of these Terms will be binding on IAMG or any of its subsidiaries or affiliates (hereinafter “IAMG”) unless made in writing by an authorized representative of IAMG.

3. Use of the Service

The cloud service offered by IAMG can be accessed by selecting the corresponding supplier shop. You can use the services offered if you have reached the legally required age to enter into a binding contract. If you choose to use our Services through an account, that account will be protected by a password.

You are responsible for maintaining the confidentiality of your account password and for all actions taken through your account. In the event of any unauthorized use of your account, you will immediately notify IAMG. IAMG will not be liable for any loss or damage arising from your failure to adequately protect your account and/or password.

You are solely responsible for 1) providing true, accurate, current and complete information about you as described in the Account Information section of the Site, and 2) maintaining and promptly updating the Account Information to ensure its accuracy, currency and completeness.

4. Ordering process

The ordering process is as follows: you upload your model that you would like to have IAMG reproduce; You choose the material, color, finish and size of the model (note: the model must be of sufficient thickness; instructions for this will be shown to you during the ordering process); You select the country to which the model should be delivered; You will receive an overview of your order and the costs (production, delivery and taxes, if applicable); You select a payment method, make the payment and confirm the order. Before paying, you will be given the opportunity to return to the process (by clicking the “Back” button). This allows errors in the ordering process to be corrected and allows you to adjust your order if necessary.

Before making payment, you must ensure that the information you provide in your order is correct and complete. Once the order is completed it is no longer possible to make changes as production begins immediately. If production has not yet taken place, changes are permitted provided this has been agreed in writing by IAMG.

When placing an order, you enter into a binding contract with IAMG upon our acceptance of your offer in accordance with these Terms and Conditions. After you have placed an order, you will receive an email confirming your order details. This confirmation means that a binding agreement exists between us, unless your offer is based on a file containing two or more models (so-called “grouped models” -> our online prices only apply to files with individual models). . In this case there is no binding agreement between us.

IAMG may revoke and/or cancel offers and orders at any time during the quotation, ordering and manufacturing process if there are technical reasons for doing so. In this case, IAMG will refund you all payments made (less any third party transaction costs).

IAMG acts in accordance with its mission to make the world a better and healthier place. IAMG therefore reserves the right, at its sole discretion and at any time, to refuse an order that conflicts with its mission and values. Firearms, their components and other prototypes or models intended for the firearms industry, as well as models for which IAMG has other ethical concerns, are not offered or manufactured. IAMG reserves the right to terminate the execution process of these orders.

The prices calculated when the order is placed are based on building types with a certain achievable level of detail. For technical reasons, certain models may not be able to be manufactured in the desired combination of material, surface finish, colour and quantity. In such cases, IAMG will make reasonable efforts to contact you. In any case IAMG reserves the right to either produce parts of a different thickness and/or use a different production technique, as well as to make any consequent changes to the order (e.g. price, delivery conditions, etc.).

IAMG retains orders placed and allows you to access your orders indefinitely. IAMG recommends that you keep a paper copy of these general terms and conditions as well as a copy of the order confirmation and the invoice.

5. Price – Payment

The price charged by IAMG includes the costs of the services provided by IAMG, the production and shipping of the product and any applicable taxes. There is no insurance. Other duties and taxes applicable to the delivery of the Product will be borne by you, even if they are not reflected in the invoice sent by IAMG. The purchaser's payment is made using a credit card.

The price is calculated in PLN, EURO or US DOLLAR (as indicated in each case). Offsetting against unrecognized counterclaims of any kind as well as the exercise of a right of retention is excluded unless such a right has been established by a court, is undisputed or recognized by IAMG. IAMG remains the sole owner of the products until full payment, including transportation costs and taxes.

Individual parts of an offer may be invoiced separately. IAMG reserves the right to refrain from carrying out further components of an offer or a subsequent offer or to suspend delivery as long as the outstanding invoices remain unpaid.

6. Delivery conditions – transport risk

The average production time for a model is approximately 10 working days. This is a provisional statement and does not bind IAMG in any way. The actual delivery time is affected by a number of circumstances, such as: B. (but not limited to) the working conditions in force at the time of conclusion of the contract or the timely delivery of the materials ordered by IAMG to carry out the order.

If your payment details are incorrect, delivery will be suspended until we receive the correct information from you.

IAMG values discretion when selecting a reputable carrier and suitable delivery methods. Risks and benefits pass to you at the time we hand over the products to the carrier. All risks during transportation are borne by you.

7. Inspection – Return – Exchange – Refund

Because the products are manufactured immediately to your specifications, there is no right of return or the ability to cancel your order within a certain period of time.

After delivery of the product, IAMG expects you to subject the product to a thorough inspection. If, after inspection, you conclude that the product does not comply with the order, you should contact us as soon as possible, but no later than 3 working days after receiving the product. If you fail to carry out the inspection and/or choose to use a non-conforming product, you will forfeit any claim you may have against IAMG in relation to the product(s).

You should not return any products without receiving express request from IAMG.

IAMG reserves the right to (partially) revoke and/or change an offer and/or an order confirmation for technical reasons.

IAMG's liability to you for any non-conformity of the Product is limited to the price paid by you for that Product. In such event, your sole remedy will be a refund of the price you paid for that Product (less any transaction fees) upon return of the Product (“Conversion”). In particular, you are not entitled to any subsequent improvement or reduction. Any other liability of IAMG, e.g. for damages including consequential damages, other indirect losses and losses as a result of liability to third parties, is expressly excluded (see the “Limited Warranty” section below).

Data can be corrupted when communicating over the Internet. Therefore, IAMG assumes no responsibility for any changes made to communications after they have been sent in this manner. It may therefore be inappropriate to rely on any information/advice contained in an email without written confirmation. IAMG assumes no responsibility for errors or problems that may arise from communications over the Internet. All risks associated with sending business-critical information about your company are borne by you. If you do not agree to this risk, you should notify IAMG in writing that communication via email is not acceptable.

8. Intellectual Property

IAMG grants you a limited, non-exclusive license to quote and place orders with IAMG. IAMG reserves all intellectual property rights and all copyrights in the PLATFORM. You may not reverse engineer, disassemble or decompile the Website.

The IAMG.com website contains names that are trademarks and/or brand names of IAMG, as well as other owners of such trademarks and/or brands. These trademarks and other IAMG brand names may not be used without the written permission of IAMG and/or the respective owner of such trademarks and/or brands. The copyright to the content of the website belongs to IAMG or other third parties. No part of the website may be copied or reproduced for commercial purposes without the express written permission of IAMG or the identified owner of the information and content.

IAMG contractually prohibits its users from using the Cloud Service to order and/or sell products that infringe the intellectual property rights of third parties (including but not limited to copyrights, trademarks, designs and models, patents, trade dress and publicity rights). ). You are solely responsible for the content that you upload to the website. By sending an order to IAMG, you confirm that you are the owner of the rights and/or that you have received from a third party the rights necessary to submit this order to IAMG for production and commercial use (see paragraph for disputes) without infringing any intellectual property rights. If the design you submit to IAMG poses a risk of infringing the intellectual property rights of third parties, IAMG reserves the right either not to produce the design at all or without producing the part that threatens to infringe the rights of third parties. If your User Generated Content is nevertheless found to be infringing and/or unlawful, you will, at your own expense, defend IAMG against any third party claims and/or indemnify IAMG from all costs incurred in defending it (including reasonable attorneys' fees) and for all ( direct and indirect) damages and costs incurred by IAMG in connection with such claims.

You acknowledge that electronic communications, databases and websites are subject to errors, malfunctions, tampering and break-ins and that their use may result in damage to your systems or adversely affect your business. Although IAMG takes reasonable precautions to prevent such occurrences, you further acknowledge that IAMG does not guarantee that such occurrences will not occur and that IAMG will not be liable for any such occurrences. You are solely responsible for ensuring that any information or content downloaded from the Website or any other website accessed from the Website does not contain viruses or other computer software code or subprograms intended to: disable, delete, impair or otherwise damage its systems, software or data. You shall indemnify IAMG from any liability, claim, cost or damage arising from any third party claim or action arising out of any such viruses, code or subprograms.

9. Production Rights

By submitting a request (containing the 3D file as well as images and text descriptions) to IAMG, you grant IAMG non-exclusive, royalty-free, worldwide production rights to 3D produce that product/design. IAMG may not reproduce the product/design to which you grant IAMG the rights, unless it is backordered.

10. Limited Warranty

IAMG guarantees that the printed model will substantially correspond to the characteristics of the ordered model, within the limits of current 3D printing technology. IAMG alone decides on the structural orientation of the model. A printed model cannot be rejected based on the chosen print orientation. Due to production reasons (different printing orientation, composition of raw materials), there may be slight visual differences between multiple copies of a model.

All information and content displayed on or made available through the Website are provided “as is” without warranty of any kind. You hereby waive all other warranties in connection therewith, including, without limitation, any warranties of merchantability, fitness for a particular purpose, or warranties against interference or infringement. IAMG does not warrant that use of the website will be uninterrupted or error-free or that any errors or defects can be corrected. Some jurisdictions may not allow the exclusion of implied warranties. If this is the case, some of the above exclusions may not apply to all users.

In no event shall IAMG be liable to any user or third party for any direct damages, loss of profits, loss of revenue, loss of business opportunity, loss of income, loss of business, loss of revenue, loss of contracts, loss of goodwill, loss of use, enjoyment, time, data, orders transmitted electronically or otherwise economic advantages of any kind (but not to the extent that applicable law prohibits exclusions or limitations of liability for intentional violations of rights, gross negligence, damages arising from production liability or other basis of liability), nor for any special, consequential, indirect, punitive or incidental losses or damages or any costs relating directly or indirectly to the use or misuse of the website or its information or content, regardless of the basis for such claim.

Under no circumstances can IAMG be held liable for product defects or for specifications requested/analyzed during the quotation phase. IAMG's liability to you for real and proven damage, regardless of the severity of the damage, is limited to the price of the product that is directly related to the cause of the claim.

11. Circumstances Beyond Our Reasonable Control

IAMG will make every effort to fulfill its obligations under these Terms. However, IAMG is not liable in the event of force majeure. Force majeure means any circumstance beyond IAMG's control - even if this circumstance was foreseeable at the time the contract was concluded - and which permanently or temporarily prevents the fulfillment of the contract, in particular transport disruptions, strikes, acts of terrorism, war, problems related to suppliers /transport, government or official measures and natural disasters. In the event of a delay, IAMG will fulfill its obligations as quickly as possible.

12. Separability

If all or part of one or more of these Terms is deemed to be illegal, invalid, unenforceable or in any way prohibited under any applicable law or regulation or in whole or in part under any applicable law, regulation of any jurisdiction or country or with respect to any particular category of If any person is found to be illegal or unenforceable, such provisions or parts thereof shall not be deemed to form part of the Agreement to that extent. This shall not in any way affect or affect the legality, validity or enforceability of the remaining provisions of these Terms or the remaining parts of the relevant provision (with respect to any jurisdiction, country or category of persons). The legality, validity or enforceability of such provision under the applicable laws of any other jurisdiction, country or class of persons shall not in any way be affected or impaired.

If any part of this disclaimer is determined to be invalid, the remaining portions will remain valid and enforceable.
